In the matter of the Estate
of John Derrickson deceased

William N. Bennett Administrator of said estate now shows to the court that there came to his hands as assets of said estate a Note made by William Derrickson to the decedent on the 25th day of December 1861 at one day for $202.00 and your petitioner inventoried the same as charged therewith, that the said William Derrickson was a son of the decedent and your petitioners informed and believes that the descendent did not intend to have said note against the said William but that said note should be given up to him to be cancelled, or should be destroyed as the decedent had given his other children more property than he had to said William That a short time before the death of the said John Derrickson he gave said note with some other papers to his granddaughter and directed her to destroy them, but by mistake said note was not destroyed but was preserved and so came to the hands of your petitioners as aforesaid, and he believes that said note should be given up to the said William and not charged against him and he further shows that said William is poor and unable to pay said note and the sum cannot be collected be said. He therefore asks for authority to surrender said note to said William and that has(sp?) administrator have audit(sp?) therefore.
